Trial Reflection Bakke v. California

 Trials Affirmative Action Case

Bakke v. California - They give the two sides some of what they want so there are 2 parts

A quota system is unconstitutional but you can use race as a factor not many factors.

Positives

To provide minorities to get into a University there are many factors to get into such as upbringings. Just because we are created equal there many separations for how white families are more likely to get a better education and have a higher acceptance rate. Diversity on campus can help impact students living on campus for it gives them a feel of other people and experiences. Diversity statements say that students learn better in a diverse campus. Economic empowerment is important for African Americans. These policies placed on Universities will help students get exposure to experiences. Using the affirmative action plan we can increase black employment and create a society for all people to succeed. African Americans are treated poorly and laws must be colorblind. The equal protection law is supposed to be used to help make African Americans equal. Congress agreed that African Americans are mistreated during events.

Negatives

College and employment have been subject to change to choose students because of race in order to fill racial quotas. To judge someone by their character not by their skin. Race should not be the determining factor of their education for someone should be judged by their qualifications rather than their race. With these in place, this could be the end of growth. Affirmative action can create reverse discrimination. Employees will often turn down a qualified candidate in order to fill their racial quota.
